எல்.பி.ஜி மானியம் பெற ஆதார் அட்டை கட்டாயமில்லை… வீரப்ப மொய்லி

உச்ச நீதிமன்றம் அனுமதி அளிக்காதவரை, சமையல் எரிவாயு மானியம் பெற ஆதார் அட்டை காட்டாயமில்லை என்று மத்திய பெட்ரோலியத்துறை அமைச்சர் வீரப்ப மொய்லி கூறினார். 

சமையல் எரிவாயு மானியத்தை பயனாளியின் வங்கி கணக்கில் நேரடியாக பணமாக செலுத்தும் திட்டத்தை அமல்படுத்த மத்திய பெட்ரோலியத்துறை அமைச்சகம் முடிவு செய்தது. அதன்படி நாடு முழுவதும் 97 மாவட்டங்களில் இந்த திட்டம் அமல்படுத்தப்படுகிறது. இதில் முதற்கட்டமாக கடந்த ஜூன் மாதம் 1ஆம் தேதி முதல் 19 மாவட்டங்களில் இந்த திட்டம் அமல்படுத்தப்பட்டது. 

இந்த திட்டத்துக்காக ஆதார் அடையாள அட்டையுடன் இணைந்த வங்கி கணக்கு கட்டாயமாக்கப்பட்டு இருந்தது. இந்நிலையில் குடிநீர், கேஸ் இணைப்புகள் உள்ளிட்ட அரசின் பல்வேறு மானியத்திட்டங்களை பெற ஆதார் அடையாள அட்டை கட்டாயமாக்கக்கூடாது என உச்ச நீதிமன்றத்தில் பொது நல வழக்கு தாக்கல் செய்யப்பட்டது. 

இந்த வழக்கை விசாரணைக்கு எடுத்துக்கொண்ட நீதிபதிகள், அரசின் மானிய திட்டங்களை பெற ஆதார் அடையாள அட்டை கட்டாய மில்லை என தீர்ப்பளித்தனர். இதைத்தொடர்ந்து சமையல் எரிவாயு நேரடி மானிய திட்டம் அமல்படுத்தப்பட்டிருந்த 19 மாவட்டங்களிலும் இந்த உத்தரவு வாபஸ் பெறப்பட்டுள்ளது.

ஆதார் அட்டைக்கு சட்ட அந்தஸ்து நிச்சயம் - மத்திய அரசு

ஆதார் அட்டைக்கு சட்டப்பூர்வ அந்தஸ்து வழங்க ஆவண செய்யப்படும் என மத்திய அரசு அறிவித்துள்ளது. நாட்டின் குடிமக்கள் அனைவருக்கும் பல ஆயிரம் கோடி செலவில் ஆதார் அடையாள அட்டை வழங்கப்பட்டு வருகிறது. அரசின் பல்வேறு மானியங்கள் மற்றும் சலுகைகள் பெற, 12 இலக்க எண் கொண்ட இந்த அடையாள அட்டை அவசியம் என்று மத்திய அரசு அறிவித்திருந்தது. 

ஆனால், இந்த அடையாள அட்டை கட்டாயம் இல்லை என உச்சநீதிமன்றம் அதிரடியாக உத்தரவிட்டது. இந்த நிலையில், ஆதார் அடையாள அட்டைக்கு சட்டபூர்வ அந்தஸ்து வழங்க வகை செய்யும் சட்ட மசோதாவுக்கு, மத்திய அரசு ஒப்புதல் வழங்கியது. செவ்வாய்க்கிழமை காலை பிரதமர் மன்மோகன்சிங் தலைமையில் நடைபெற்ற அமைச்சரவை கூட்டத்தில், சில திருத்தங்களுடன் அந்த மசோதாவுக்கான ஒப்புதல் வழங்கப்பட்டது. 

அதைத் தொடர்ந்து, இந்த புதிய சட்ட மசோதா பாராளுமன்றத்தின் வருகிற குளிர்கால கூட்டத்தொடரில் ராஜ்யசபையில் தாக்கல் செய்யப்படும் என்று உயர் அதிகாரி ஒருவர் தெரிவித்தார். இந்த சட்டத்தின் மூலம், ஆதார் அடையாள அட்டை திட்டத்தை அமல்படுத்துவதை கண்காணிப்பதற்கான தேசிய அடையாள ஆணையம் ஒன்றை புதிதாக அமைக்கவும் வழிவகை செய்யப்படும். இந்த திட்டத்தின் கீழ் திரட்டப்படும் தகவல்களை தவறாக பயன்படுத்தினால், அதற்கான தண்டனை குறித்த விதிமுறைகளும் புதிய சட்ட மசோதாவில் இடம் பெற்று இருக்கும். 

இந்திய நாட்டு குடிமக்களுக்கு மட்டுமின்றி, யார்-யார் இந்தியாவில் வசிக்கிறார்களோ, அவர்கள் எந்த நாட்டைச் சேர்ந்தவர்கள் என்றாலும் அனைவருக்கும் ஆதார் அடையாள அட்டைகள் வழங்கப்படும். தனி நபர் ஒருவரைப் பற்றிய அடையாளத்தைதான் இந்த அட்டை குறிக்குமே தவிர, அவர்கள் நாட்டைப்பற்றி அல்ல. 

இருப்பிட சான்றாகவும் இந்த அட்டையைப் பயன்படுத்திக்கொள்ளலாம். அதே நேரத்தில், விருப்பம் உள்ளவர்கள் இந்த வசதியைப் பயன்படுத்திக்கொள்ளலாம். அனைவரும் கண்டிப்பாக ஆதார் அட்டையை வாங்க வேண்டும் என்பது சட்டபூர்வ கட்டாயம் அல்ல என்பது குறிப்பிடத்தக்கது.

ஆதார் அட்டை: மத்திய அரசின் கோரிக்கையை நிராகரித்த உச்ச நீதிமன்றம்

மத்திய அரசின் திட்டப்பணிகளை பெற ஆதார் அட்டை அவசியமில்லை என்ற உத்தரவில் மாற்றம் செய்ய உச்ச நீதிமன்றம் மறுப்பு தெரிவித்துள்ளது. 

மத்திய அரசின் சேவைகள், சம்பளம், வருங்கால வைப்பு நிதி பட்டுவாடா, திருமணம், சொத்து பதிவு செய்தல், நேரடி மானிய திட்டத்திற்கு ஆதார் அட்டை அவசியம் என மத்திய அரசு ஏற்கனவே அறிவித்திருந்தது. இதற்கு எதிராக உச்ச நீதிமன்றத்தில் பொதுநல வழக்கு தாக்கல் செய்யப்பட்டது. 

இந்த வழக்கில், அரசின் திட்டப்பணிகளை பெற ஆதார் அட்டை அவசியமில்லை என உச்ச நீதிமன்றம் கடந்த மாதம் தீர்ப்பளித்தது. இதனைத் தொடர்ந்து, இந்த தீர்ப்பில் மாற்றம் செய்ய வலியுறுத்தி மத்திய அரசும், எண்ணெய் நிறுவனங்களும் இணைந்து, உச்ச நீதிமன்றத்தில் மனு தாக்கல் செய்தன. 

ஏழை மக்களுக்கு வழங்கப்படும் மானியம் சரியான நபருக்கு செல்ல வேண்டும் என்ற காரணத்தினால் மானிய திட்டங்களுக்கு ஆதார் அட்டை கட்டாயம் தேவை என மத்திய அரசு தனது மனுவில் குறிப்பிட்டிருந்தது. உடனடி மனுவாக இதை ஏற்று இன்று விசாரித்த உச்ச நீதிமன்றம், அரசின் திட்டப்பணிகளை பெற ஆதார் அட்டை அவசியமில்லை என்ற உத்தரவில் மாற்றம் செய்ய மறுத்துவிட்டது. 

உச்ச நீதிமன்றத்தின் இந்த உத்தரவு மத்திய அரசுக்கு பெரும் பின்னடைவாக கருதப்படுகிறது. இதனிடையே ஆதார் அடையாள அட்டை ஆணையத்திற்கு சட்ட அங்கீகாரம் வழங்கும் மசோதாவிற்கு மத்திய அரசு இன்று ஒப்புதல் அளித்துள்ளது குறிப்பிடத்தக்கது.

Bill that gives statutory backing to Aadhaar gets Cabinet nod

The Union Cabinet has cleared the National Identification Authority of India Bill, that gives legal and legislative backing to its Aadhaar numbers programme and the Unique Identification Authority of India (UIDAI) that runs the programme.

The Bill, which will likely be taken up in the winter session of Parliament, is long overdue and its consideration by the cabinet may have been prompted by the Supreme Court’s observations that the Aadhaar number cannot be mandatory for government schemes.

The government wants to make Aadhaar the backbone of its direct benefits transfer programme for everything from scholarships to cooking gas subsidy.

Interestingly, the Bill was earlier rejected by the standing committee of finance headed by Yashwant Sinha of the Bharatiya Janata Party (BJP) in December 2011.

Mint learns that the Bill is based on a new draft that has been shared with the standing committee, and that at least some of the panel’s suggestions have been incorporated in it, and some, rejected.

The Bill gives statutory backing to UIDAI and also defines its powers. It also seeks to protect the privacy of individuals.

According to the Bill, the total cost of the project will be Rs.12,400 crore.

The government’s Aadhaar programme has been opposed by activists for reasons ranging from misuse of data to breach of privacy, and ever since its adoption by the Congress as one of the key talking points ahead of next year’s general elections, it has attracted the ire of opposition parties as well.

UIDAI chairman Nandan Nilekani may contest the Lok Sabha elections from Bangalore as a Congress candidate.

Supreme Court to hear pleas against Aadhar today

The petition of Roy and others came up before a bench comprising Justices BS Chauhan and SA Bobde which said it will be heard along with the applications filed by the Centre and the three oil PSUs seeking modification of its earlier order that Aadhar card is not mandatory and no person should suffer for want of it in getting benefits of government schemes.

"The enrolment under the UIDAI scheme is purportedly voluntary - yet many welfare schemes of the State seem to mandate the need for an Aadhar number to access those schemes - effectively making Aadhar enrolment compulsory," the petition filed by social workers said.

The petition also said the manner in which the biometric details of the citizens are collected by private contractors and NGOs hired by UIDAI without any safeguard makes it prone to misuse not only by private actors but also by the State.

"In the present day and age, where every country is facing the problem of identity frauds, usage of fake identities for money laundering, terrorism, etc., UID is letting private contractors collect sensitive data of persons, which is not protected or governed under any law, whatsoever.

The petitioners also claimed there is an empirical research to show that the biometric identification denoted for UID, namely the Iris Scan and finger print Identification, is faulty and capable of misuse.

"Without a statutory framework determining accountability, data-protection, offences for violation etc., UID is putting in jeopardy not only life and rights of people but also security of our country," the petitioners said.

The Centre on Friday moved the Supreme Court seeking modification of an earlier order, which said Aadhaar card is not mandatory and no person should be deprived of any government schemes for want it.

A bench headed by Chief Justice P. Sathasivam said that the plea of the Centre would be taken up for hearing on October 8.

“We seek modification of the order, which said that Aadhaar card is not mandatory,” Solicitor-General Mohan Parasaran, appearing for the Centre, said, adding that the order may come in the way of various welfare schemes.

Earlier, the Supreme Court had said that the Aadhaar card, being issued by Unique Identification Authority of India (UIDAI), was not mandatory for availing any government services and nobody should be deprived of any such facilities for the want of the card.

The Centre had also told the court that the Aadhaar card was optional and that it has not made it mandatory for the citizens.

The apex court had passed the earlier order while hearing a batch of pleas against decisions of some States to make Aadhaar cards compulsory for a range of activities including salary, PF disbursals and marriage and property registrations.
