Cabinet clears note to remove former SC judge Ganguly as WBHRC chief

A government note to remove former Supreme Court AK Ganguly as Chairperson, West Bengal Human Rights Commission is ready and expected to be cleared by Union Cabinet on Thursday, Home Ministry sources said. The development took place after West Bengal Chief Minister Mamata Banerjee sought Ganguly's removal following allegations of sexually harassing a law intern at a hotel in Delhi.

After the Cabinet approves the proposal, a formal advice will be sent to President Pranab Mukherjee to remove Ganguly. Attorney General GE Vahanvati had given his opinion favouring tough action against Ganguly.

There are several allegations against Ganguly including that of sexual harassment, travelling to Pakistan without government clearance and also taking arbitration assignments without prior approval.

In her letter to President Mukherjee, Mamata had claimed that a Delhi-based NGO had paid for Ganguly's visit to Pakistan in June 2013 without government clearance violating WBHRC rules.

After the note is cleared, the President will make a reference to Chief Justice of India P Sathasivam. The Chief Justice of India will then investigate the case and recommend according to the procedures set out in the Protection of Human Rights Act.

Justice Ganguly has steadfastly refused to resign despite demands from the political class, lawyers' bodies and social organisations.
