The Supreme Court will on October 8 hear a PIL by BJP leader Subramanian Swamy seeking quashing of the April 24 agreement between India and the United Arab Emirates, which he alleged gave unfair concessions to Etihad Airways and India's Jet Airways.
He said Etihad, the UAE's national carrier, was granted an "unprecedented, arbitrary, irrational and unsustainable" additional 36,670 seats per week — over and above the existing 13,330 seats per week — in capacity enhancement to Abu Dhabi, in addition to allowing it third country code sharing and domestic code sharing.
"It is the petitioner's case that this increase in capacity entitlement together with code sharing permission was made with the underlying intention to grossly and unjustly enrich the foreign airline for collateral purposes and in the process encourage foreign investment into a private domestic airline, Jet Airways, that acted as a facilitator," he said.
